Terms of Service
All services provided by High Time Design are subject to the following terms
and conditions. These policies are intended to protect my clients and High Time
Design. If you disagree with any of the terms set forth on this page, do not
enter into a contract with High Time Design for any service offered. When you
enter into a contract for a project, you are implying that you are in full
agreement with the terms of service described herein.
Acceptance of Terms
Please note that by submitting your deposit for services from High Time
Design, you are agreeing to all terms of service as described herein. High Time
Design reserves the right to change or update these terms at any time without
prior notice.
Quotes & Contracts
Quotes provided are valid for 30 days. If the client does not sign a contract
for High Time Design to begin work within 30 days, a new quote will be provided
upon request.
Charges & Fees
All projects require 50% deposit payment with signed contract. The balance is
due and payable upon project completion, and before it is released to you, your
assigns, or published to the internet.
Final balance payments not received within 10 days of billing notice incur a
$25 per day late fee. Check payments returned for nonsufficient funds will be
charged a $25 fee. High Time Design retains the right to hold any and all
graphics and project development, with the exception of content and graphics
provided by the client, until payment is received.
Project Delivery
High Time Design agrees to complete the web design project within 60 days
from the date of contract signing, unless other project schedules have been
agreed to and signed into contract by both parties (High Time Design and the
client.) If the client does not supply High Time Design with complete text,
graphic content and other requested materials for the contracted project within
30 days of contract signing, the contract becomes void and all deposits paid by
the client will be forfeited.
Refunds
High Time Design requires a deposit before work begins on any project. A
request to terminate services must be presented to High Time Design in writing.
Refund amounts are calculated as follows:

A cancellation fee of 20% of the deposit paid will be retained for
projects that have been contracted, but cancelled prior to their start date.

A cancellation fee of 30% of the deposit paid will be retained for
projects that have been started and are in the design phase at the time of
termination request.

A design fee of $200.00 will be retained on projects where the design
phase is completed, the client has accepted the design, but the development
phase of the project has not yet begun.

Projects that are in the development phase at the time the request for
termination is received, will be billed at the hourly rate of $45 per hour.
If the time-to-date invested in your project is greater than the deposit
paid, the difference will be billable to the client for immediate payment.
Upon payment of these fees, the work completed prior to the termination
request will be released to the client.

Refunds will be processed within 30 business days of the client's
termination request, if there is a refund due the client based on the terms
herein.

If we are unable to communicate with a client by phone or email in
regard to a project for a duration of sixty consecutive days (60) during the
design and development phases, the project will be canceled without prior
notice, and no refund will be issued.

Because web site hosting is not provided by High Time Design, nor billed
from High Time Design, we are unable to issue refunds on hosting and domain
services already paid. mjrSolutions offers an initial 30-day guarantee for
hosting services provided. Please review their Terms of Service, which is
provided to you, the client, prior to the first billing cycle.
Copyright & Credit
Upon completion of your project, ownership rights of all graphic elements and
page designs created by High Time Design remain copyrighted to High Time Design.
You, the client, are given rights to use the graphics, but not given
permission to resell the graphics to a third party, duplicate graphics for
resale, or claim authorship. High Time Design reserves the right to display
website designs that have been created by High Time Design on our website and in
marketing materials to serve as portfolio examples of completed work. Copies of
all files will be provided the client at the completion of the project. Website
designs created by High Time Design require a text link back to High Time
Design.com. Your website design will include this link as part of the bottom
border text. The client guarantees that this link will remain in place unless or
until said design is no longer published to the internet. Removal of this link
is a violation of this agreement.
Liability
Services purchased from High Time Design are provided "as is" without
warranty of any kind that the web design project will be uninterrupted or error
free. In no event shall High Time Design be liable to the client for any direct,
indirect, special, punitive, incidental, or consequential damages arising out of
the use of the website, its control panel, services, and/or goods provided to
the client. This includes, without limitation, lost profits, business
interruption, loss of data or other losses directly resulting from the use of
the website, its control panel, services, and/or goods provided to the client.
Project Acceptance
High Time Design we will not accept projects that we find morally
questionable, unethical, or otherwise distasteful. Website projects of a
pornographic nature or those that require viewers to be 18 years or older will
not be accepted.
Notice: This Agreement shall be governed by and construed in accordance with
the laws of the State of Ohio. Exclusive jurisdiction and venue is as governed
in the 9th district court of Ohio.
